General Information

This site is owned and operated by MAD Tech Services. By using or accessing this website you acknowledge that you have read, understood and agreed to be bound by the terms and conditions listed in this website (Terms & Conditions). If you do not agree to the Terms & Conditions, please do not use this website.

This terms and conditions document covers all sales conducted by MAD Tech Services including both online and offline sales.

Consumer Guarantees

All products sold by MAD Tech Services come with guarantees that cannot be excluded in this country under the Australian Consumer Law (ACL). You can find out more information at http://www.accc.gov.au

You are entitled to a replacement or refund for a major failure or defect. You are also entitled to have the goods replaced or repaired if the goods fail to be of acceptable quality and the failure does not amount to a major failure. This entitlement is provided that no misuse or incorrect handling of the product has taken place.

Repairs by the Manufacturer

Goods presented for repair may be replaced by manufacturer-refurbished goods of the same type rather than being repaired.

Pricing and Order Acceptance

Please note that advertised prices for the same goods may vary from place to place. One store may offer to sell particular goods at a lower price than the same goods at another store. This also includes online stores such as eBay and our online store.

MAD Tech Services reserves the right to not be at a loss on any sale. This includes mistyped prices on any product.

All prices shown on www.madtechservices.com.au, in our retail outlets and on our other online stores (eg. Ebay, amazon, facebook etc.) will include Australian GST of 10%. All prices are subject to change without prior notice.

Your order confirmation email will also show the including GST total, the same as the tax invoice. You will receive a tax invoice from MAD Tech Services once we have accepted your order and shipped it to you.

Prices change occasionally and while every effort is made to be accurate, sometimes it is beyond our control and we will contact you if a price has changed significantly from our published or advertised price once you have made your order or offer to purchase. An order is an offer to purchase and does not constitute as a binding contract until it is accepted by MAD Tech Services.

A binding contract only exists once we deliver your order.

Any automated confirmation of a successful order placement and/or receipt and/or our processing of a payment for an order through the Site does not constitute acceptance of an order by us. If we decline your order after a payment for the order has been received / processed, we will contact you with the details and refund the payment in full.

Where for example, prices have been incorrectly advertised, or where there was a programming error, there is no contract. We reserve all rights to correct any error or omission.

Product descriptions are not warranted by MAD Tech Services as correct, complete, current, reliable or error free. If the product is not as described, please return the product with all its original packaging and in an undamaged state.

MAD Tech Services will acknowledge acceptance of your offer (known as a binding contract) by shipping your order to you.

All payments must be cleared before any products are dispatched for delivery.

An order will not be considered for acceptance until full funds have been received and cleared.

We charge for credit card transactions in most cases, you will be notified in these cases. The credit card surcharge is usually 2% in addition to the total price.

Ownership of any product that you purchased will only be transferred to you once all funds are received and your payment has fully cleared.

We are not responsible for any delays associated with processing your payment caused by a third party or by any financial institutions.

A restocking fee may apply to any returned goods.

MAD Tech Services does not allow returns based on change of mind or incorrect purchases.

Any backorder goods may be cancelled or changed while the product remains in backorder status without incurring a restocking fee.

Shopping and Delivery Policy

We ship to all destinations in Australia only, using Australia Post or another carrier of our choosing. Shipping costs are calculated by the checkout. In some cases where the cost of shipping becomes extreme due to remote location or other circumstances that may increase the shipping fees we reserve the right to cancel the order unless further payment is made to cover these extra costs.

In most cases product insurance is optional and at an extra cost, you will be notified during the checkout process. This can sometimes be chosen depending on what carrier service you choose.

Delivery costs are influenced by the size and weight of the product and also on the delivery destination.

Shipping costs and options are described in the MAD Tech Services online store during the checkout process.

We aim to ship all orders in a timely manner, this is usually between 1-5 business days depending on our workload and if products are in stock. In some situations where products are out of stock we will do our best to reorder the item. In the case of an item going on backorder you will be notified and offered a replacement product or full refund.

Shipping times are estimated between 1 to 10 business days depending on the delivery location in Australia. Sometimes it can take longer in remote destination or busy periods (eg. Christmas or New Year). The shipping time estimate is also subject to the limitations of our third party carriers. All risk of loss or damage to the products passes to you once we have dispatched the items unless you have opted for parcel protection during the checkout process.

If we are unable to dispatch your order we will notify you during our handling period which is between 1-5 business days.

Returns, Refunds & Exchanges

You are solely responsible for your purchase(s), so please take care when choosing your products before placing and paying for your order.

We will not provide refunds based on incorrectly ordered goods which have been dispatched for delivery or delivered to you.

We can try and help you with advice while choosing your products however we will not be held responsible for incorrect selection of products ultimately decided by you. Any advice we give is given as advice only and cannot be used as a reason for incorrect purchases. It is ultimately your decision that is final and binding.

If you purchased goods, which have been shown to have been defectively manufactured, we will replace it only if we still have the same goods, and if not, where possible, we will offer you a refund or exchange for similar goods. This is decided on a case-by-case basis. However, you must return to us the goods within 7 days of you receiving them. If not, this warranty does not apply. All goods will be checked for misuse or mishandling before any replacements or refunds take place.

If you have any goods repaired or attempted to be repaired by any other parties besides MAD Tech Services, the warranty mentioned above does not apply.

We can only satisfy any warranty claims as mentioned above after we have tested the products and confirmed them to be defective. Please be patient in this regard as each item has different tests and some items need to be sent back to the manufacturer for further testing and this can take some time.

You must pay for any return shipping and ensure that returned products are packed and shipped to a safe and satisfactory standard.

Any orders change of mind after you have paid for a product may result in an administration and restocking fee if you ask for a refund, this decided on a case by case basis. Administration fee is $10.00 and restocking fee is 15% of the total order cost.

General Warranty

MAD Tech Services provides a 12 month from the date of purchase ‘RTB’ (Return To Base) warranty on all goods sold. Customers are liable for any return postage which may incur. When you use the Return To Base warranty on your goods, we will repair them or at our option replace them when we consider them defective.

Where we choose to replace the product(s), the exact model of the goods may not be available and in such cases, at our discretion, we have the right to substitute the goods with a similar product. We will do our best to ensure the product has the same features and functions.

If you have goods which you believe are faulty, please ensure that you have correctly installed, configured the product. Also ensure that you have thoroughly tested the product before returning it to us as incorrectly diagnosed ‘faulty products’ may incur a testing and administrative fee.

Goods will not be returned to you or tested until you have paid any administrative or return postage fees. We will not accept COD deliveries under any circumstances.

You must provide proof of purchase with all warranty claims. Proof of purchase must be your original tax invoice provided by MAD Tech Services when you purchased the products.

You are responsible for the storage of all your invoices/receipts. We can refuse to reissue an invoice and if we do reissue an invoice it may incur an administrative fee.

You must return goods in its original packaging, or well packed so that the goods does not sustain any damage in transit. You must also return all software, cables, small parts and manuals when you do so.

You must not return any software you claim to be defective. Under no circumstances will we accept returned software. We provide no warranty whatsoever with respect to any software.

For online purchases:
If a part is found to be faulty we will refund the costs of shipping for returning the item and will cover the costs of reshipping.

For store and onsite purchases:
Please return to the store of purchase or if it was an onsite purchase contact us to arrange for pickup.

Privacy

Please review our Privacy Notice, which also governs your visit to our website, to understand our practices. All sensitive information (personal contact details & credit card information) is transported safely to our server using a SSL connection.

Communications

When you visit MAD Tech Services or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

By visiting MAD Tech Services, you agree that the laws of the state of Victoria, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and MAD Tech Services or its associates.

Disputes

Any dispute relating in any way to your visit to MAD Tech Services or to products you purchase through MAD Tech Services shall be submitted to confidential arbitration in Victoria, except that, to the extent you have in any manner violated or threatened to violate MAD Tech Services intellectual property rights, MAD Tech Services may seek injunctive or other appropriate relief in any state or federal court in the state of Victoria, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

Disclaimer of warranties and limitations of liability

This site is provided by MAD Tech Services on an ‘as is’ and ‘as available’ basis. MAD Tech Services make no representations or warranties of any kind, express or implied as to the operation of the site or the information, content, materials or products included on the MAD Tech Services website. You expressly agree that your use of the MAD Tech Services website is at your sole risk to the full extent permissible by applicable law. MAD Tech Services disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for particular purpose.
